President Donald Trump’s administration used two crucial procedural maneuvers — called an “automatic stay” and “pretermittance” — to keep the El Gamals detained. Previous administrations seldom used either tactic, but they have become far more common during Trump’s second term, according to hundreds of pages of court records and interviews with experts and attorneys. ⁠

By using the automatic stay, ICE exerts its authority to block a migrant’s release from detention, even if an immigration judge has ordered it. ⁠
