Petitioner (A File #: 249-276-465) asserts that he was arrested just four days ago "during a routine ICE check-in" (Doc. 1 at 2) However, he attaches an "Order Of The Immigration Judge" signed on April 16, 2026 denying bond for purported jurisdictional issues. (Doc. 1-3 at 2) This order makes clear that the hearing was an "In Custody Redetermination Proceeding[ ]." Id. Thus, either the petition has purposefully misrepresented the date of petitioner's arrest, or it is a typographical error. Thus, because Petitioner has failed to demonstrate that his TRO is timely, it is DENIED. Local Rule 231(b). The Court refers the matter to the assigned magistrate judge for a determination on the merits. The Court sets the following briefing schedule, which may be modified by the magistrate judge as needed. Respondents SHALL file their responsive pleading within 21 days. Petitioner may file a traverse no later than 7 days after the respondents file their brief.In the meantime, unless and until the Court orders otherwise, the Court ORDERS that Respondents shall not remove Petitioner from the United States nor transfer Petitioner out of this District.
