PROVIDENCE, R.I. (WPRI) — A Rhode Island judge questioned a member of the U.S. Attorney’s Office during a virtual hearing Monday after federal officials failed to disclose that an Immigration and Customs Enforcement detainee was wanted for murder overseas.Last week, U.S. District Court Judge Melissa DuBose ordered the conditional release of Bryan Rafael Gomez, who had been taken into ICE custody on an assault and battery charge in Worcester.The decision quickly drew criticism after the Department of Homeland Security accused DuBose of releasing Gomez while knowing he had a warrant for murder in the Dominican Republic.However, it was later revealed DuBose had never been notified of the warrant, and it was not disclosed in court during Gomez’s immigration proceedings before she issued her ruling.Assistant U.S. Attorney Kevin Bolan later apologized, saying ICE instructed him not to share the information due to a “legitimate law enforcement reason.” According to newly filed court documents, ICE claims Dominican Republic officials had not authorized disclosure of the warrant as of April 27. ICE said it received permission to disclose the warrant on Thursday, but had previously posted about the murder allegations online, contradicting that claim.DuBose is now considering holding the federal government in contempt of court over what she called a “breach of trust.” She held the show-cause hearing over Zoom to determine why the information was withheld and to prevent it from happening again.“This entire situation fell down basically because there was a decision made not to be truthful to the court” DuBose said Monday.She asked Bolan several questions during the hearing, where he apologized multiple times and said he wished the situation had been handled differently.Melanie Shapiro, Gomez’s attorney, told 12 News she was also unaware of the warrant and called the lack of disclosure “troubling.”“As a result of that, this judge has been vilified in the media,” Shapiro said. “I think that is beyond just gross negligence, its deliberately withholding information … It’s harmful to the court. It’s harmful to the judge. It’s harmful to the judicial process and the trust in the courts and the public, and more fodder for this inflammatory rhetoric that we’ve been seeing.”No decisions were made during the hearing.
