Federal agents arrested an undocumented man at his home in San Jose while he was on his way to work Saturday, his family told NBC Bay Area. 42-year-old Gerardo Rosas Leyva’s wife, Idalia, told NBC Bay Area federal agents with U.S. Immigration and Customs Enforcement arrested him outside their home as the family and neighbors took video. According to the family’s Ring video, Rosas Leyva was in his black truck at 7:45 a.m. about to head to his construction job when multiple people, who appear to be federal officers, approached his truck and yelled for him to get out. Idalia, who says she is a U.S citizen, ran to the truck to try to stop the arrest. She says one agent tased her as she tried to block him, and a woman not in uniform hit her 22-year-old daughter with a baton, although neither incident is shown in the footage. ICE did not respond Saturday to NBC Bay Area's request for comment but emailed a statement on Wednesday from Assistant Secretary of Homeland Security Tricia McLaughlin that states in part, “ICE arrested Gerardo Rojas-Leyva, a criminal illegal alien from Mexico. His rap sheet includes lewd and lascivious acts with child, battery of a spouse, domestic battery, and providing compensation for prostitution. This pedophile illegally re-entered the U.S. after a previous removal – a felony – at an unknown date and time.” NBC Bay Area has not been able to independently confirm his earlier deportation or re-entry to the U.S., but we did search Leyva’s criminal record and have confirmed convictions for lewd and lascivious acts on a 14-year-old child in 2018, solicitation of prostitution in 2021, DUI in 2008, and three separate cases of domestic violence in 2003, 2008 and 2013. Immigrant support groups are warning their communities to stay vigilant. A major federal immigration enforcement operation planned for the Bay Area was recently called off, but targeted ICE arrests are still happening. Local Watch the family’s footage in the video above.
