(jgo) 3 Mar 10, 2026 ORDER re: 1 Petition for Writ of Habeas Corpus filed by Angelica Maria Suescun Contreras. The Court is in receipt of the habeas corpus petition. Dkt. 1. The petition is partially granted as follows: Respondents are enjoined from transferring petitioner to any location outside the Southern District of New York, the Eastern District of New York, or the District of New Jersey absent this Court's prior approval. Respondents are ordered to file their response to the pending petition for habeas corpus by March 11, 2026 at 5:00 PM. That briefing should address (1) the basis for petitioner's detention, (2) the circumstances of the arrest, (3) whether petitioner has previously been detained in immigration custody and released (and under what authority), (4) what process petitioner was given, and (5) depending on the basis for detention, whether it is distinguishable from the issue addressed in the Court's prior ruling in J.G.O. v. Francis, 2025 WL 3040142 (S.D.N.Y. Oct. 28, 2025). Petitioner may submit a reply by March 13, 2026 at 5:00 PM. The Clerk of Court is respectfully directed to send a copy of this order to Jeffrey.Oestericher@usdoj.gov. SO ORDERED. (Entered: 03/10/2026) Main Document Order AND ~Util - Set Deadlines 4 Mar 11, 2026 LETTER addressed to Judge Arun Subramanian from Tudor Neagu dated March 11, 2026 re: Government's Letter Memorandum of Law in Opposition to the Petition. Document filed by Judith Almodovar, Pamela Bondi, Todd M. Lyons, Kristi Noem. (Attachments: # 1 Exhibit A, Record of Deportable-Inadmissible Alien, Form I-213, Mar 10, 2026, # 2 Exhibit B, Notice to Appear, Jan 5, 2024, # 3 Exhibit C, FBI Identity History Report).(Neagu, Tudor) (Entered: 03/11/2026) Main Document Letter 5 Mar 12, 2026 ORDER: 1. Counsel for respondents is directed to enter a notice of appearance to ensure notification of future orders. The Clerk of Court is respectfully directed to email a copy of this order to tudor.neagu@usdoj.gov. 2. In their letter, respondents assert that ICE used its discretion to (1) revoke petitioner's release and (2) to detain her, given her recent criminal charges. However, no supporting affidavit attesting to these facts was provided. Within seven days of this order, respondents are directed to submit an affidavit or sworn declaration from an individual with personal knowledge of the circumstances surrounding the decision to revoke petitioner's parole and to detain petitioner. In addition to providing general details of the circumstances surrounding the detention, it should state (1) whether a warrant was issued prior to petitioner's arrest and (2) whether petitioner was detained after an individualized determination because of the alleged criminal conduct, or without an individualized determination because detention was thought to be mandatory. Respondents should further provide the legal basis for their position that an IJ bond hearing, rather than release, would be the appropriate remedy in this case if J.G.O. is applicable. Courts in this district have gone different ways on this question, but what's missing is a principled explanation as to why, despite release being the conventional remedy on a habeas petition, the appropriate remedy here would be a bond hearing instead. 3. Petitioner may respond to any filing within two business days. (Signed by Judge Arun Subramanian on 3/12/2026) (sgz) Transmission to Docket Assistant Clerk for processing.
