(WOLF) — A Guatemalan national is facing federal charges after authorities say he assaulted an immigration officer and was unlawfully in the United States.The U.S. Attorney’s Office for the Middle District of Pennsylvania announced that a federal grand jury has indicted Marco Antonio Herrera on charges of assaulting a federal officer and illegal entry.According to prosecutors, Herrera was located by Immigration and Customs Enforcement officers on April 1 in Williamsport. Officials allege he did not have legal authorization to be in the country.During the encounter, investigators say Herrera resisted officers and struck one of them with his elbow while they attempted to take him into custody.The case was investigated by U.S. Immigration and Customs Enforcement and Removal Operations. Assistant U.S. Attorney Geoffrey W. MacArthur is handling the prosecution.If convicted, Herrera could face up to eight years in federal prison, along with supervised release and possible fines. Federal sentencing will be determined by a judge based on applicable guidelines.
