The El Gamal family, which spent 10 months in Immigration and Customs Enforcement (ICE) detention before authorities released them on Thursday, have been granted an emergency relief after federal authorities took them into custody again, according to attorney Eric Lee.Hayam El Gamal and her five children, ages 5 to 18, were released this week after nearly a year in federal custody when U.S. District Judge Fred Biery of the Western District of Texas ordered their release.Lee, a family attorney, posted on Saturday afternoon that a federal court had granted an emergency motion to stop the administration from deporting the family, and that "the plane is landing in Michigan in an hour. It constitutionally cannot be allowed to take off."A screenshot of the order showed Biery signed the order, which issues a stay against the family's removal from the U.S. and from the District of Colorado.He later posted a flight map for a plane he said was the El Gamal deportation flight, which showed the plan reversing course and returning to the airport."We are told the family will be released, but we don't trust a word they say," Lee wrote. Representative Joaquin Castro of Texas, a Democrat, also confirmed that the family was headed back to Denver, writing on X: "They deserve fair treatment under the law." Upon the family's release earlier this week, DHS spokesperson Lauren Bis said in a statement, per NBC News: "The judge wants to release this terrorist’s family onto American streets. Under President Trump, DHS will continue to fight for the removal of those who have no right to be in our country, especially national security threats."Representative Greg Casar of Texas, a Democrat, highlighted the attempted deportation of the El Gamal family as "outrageous," saying that it "undermines the rights of every single American." "A federal judge ordered the Trump Administration not to detain or remove the El Gamal family. ICE waited until the family had left Texas, then defied the judge's order," Casar wrote on X. "If they can ignore a court order to go after this family, anyone could be next. ICE must release the Gamal family," he added. In a statement to Newsweek, Bis on Saturday said: “Mohammed Soliman is a terrorist responsible for an anti-Semitic firebombing in Boulder. The family received full due process and was issued a final order of removal on December 29, 2025. They appealed the judge’s decision. The board of appeals upheld the final order of removal on April 22, 2026. Despite receiving full due process, this activist judge appointed by Bill Clinton is releasing this terrorist’s family onto American streets AGAIN.""Under President Trump, DHS will continue to fight for the removal of those who have no right to be in our country—especially terrorists and their associates. We are confident the courts will ultimately vindicate us," Bis added. Hayam El Gamal's Health ConcernsIn a post on April 14, Lee had revealed that El Gamal suffered a "serious medical emergency" during her detention - a growth on her chest that caused her pain "for many weeks," during which she had made complaints to ICE and appropriate staff but had been denied a medical visit.However, after experiencing "excruciating" pain, which she described as "being stabbed through the back to the stomach," staff allowed her to be taken off-site to an emergency room, where she received lab work and a CT scan that proved inconclusive about the lump but found "fluid around the heart."Other options that doctors suggested were denied, and ultimately El Gamal returned to the detention facility."After 10 months in detention, Ms. El Gamal remains in pain. We are concerned that the systematic denial of medical attention may result in her death," Lee wrote. DHS has denied the allegations of delayed or denied treatment for El Gamal.
