Don Hutto ICE Detention Center Monday after his legal team filed a habeas corpus petition, according to the family and Mano Amiga San Marcos.Gerardo Reyes Gonzalez, 44, returned home after more than 60 days in federal custody. His release came after a judge ruled on the petition challenging the legality of his detention. His immigration case is ongoing.Reyes Gonzalez was arrested March 14 when San Marcos police stopped a vehicle after a mother reported an unidentified male appeared to be leaving her apartment complex with her 15-year-old daughter. Officers stopped a truck matching the description, finding Reyes Gonzalez's 17-year-old son Esteban behind the wheel. ICE placed a detainer on him following the arrest.The Hays County District Attorney dropped the criminal charge against him on May 11. The city of San Marcos acknowledged that Officer Jaciel Cortina committed three department policy violations during the arrest, including making inaccurate statements and failing to properly investigate before making arrests. Cortina received a 24-hour suspension.Esteban Reyes' charge remains in pre-file diversion status. His family is demanding full dismissal. The family and community advocacy group Mano Amiga are also calling for greater accountability for Cortina and policy changes at the San Marcos Police Department, including an end to police-ICE collaboration in Hays County.CBS Austin reached out to ICE for a statement and has yet to hear back.
