(DC News Now) — Montgomery County Sheriff Maxwell C. Uy released a statement Saturday condemning the transfer of a person into the custody of federal immigration authorities on Thursday, Jun. 18, after receiving backlash from the Montgomery County Council.Council President Natali Fani-González claimed that Uy failed to comply with the Maryland Community Trust Act.The act, passed in April 2026 by the Maryland General Assembly, prohibits local law enforcement from taking certain actions related to immigration enforcement, including transferring a person to Immigration and Customs Enforcement (ICE) custody without a judicial warrant.The legislation has been controversial, with 17 of the state's 24 sheriffs suing Maryland, filed on their behalf by the Federation for American Immigration Reform. Sheriffs sue Maryland over new law restricting immigration coordination "As an immigrant who has faced the threat of deportation, I know firsthand the fear many families live with. I'm extremely frustrated by reports that Sheriff Maxwell Uy failed to ensure that law enforcement policies and practices in the Sheriff's Office adhere to the Maryland Community Trust Act. Before the state act took effect, I spearheaded with my Council colleagues the Montgomery County Trust Act to prohibit the use of County resources in federal civil immigration enforcement. We expect our law enforcement officials and County employees to follow the law and protect the civil rights of all our residents."In Uy's response, the MCSO stated that deputies received a detainer request from ICE after the person was deemed a "risk to national security and public safety," prompting deputies to release the subject to ICE's custody.However, Uy stated that this decision was "improper" and did not meet the exceptions of the Community Trust Act. The MCSO stated it is implementing additional measures to prevent this incident from occurring again."Sheriff Uy remains committed to ensuring that his office and staff have the trust of the immigrant community in Montgomery County. The MCSO has never engaged in immigration enforcement and does not make inquiries regarding immigration status.
