Advocates, family call for asylum seeker detained by ICE to be freedHARRISBURG, Pa. —Advocates and lawyers for an asylum seeker living in Harrisburg who was detained by ICE last year spoke out Tuesday, demanding he be freed after more than five months of being in federal prisons.There was an event in downtown Harrisburg Tuesday morning in support of Omar Vidaurre-Luis. According to his lawyers, he was detained last year while appearing for a court proceeding on charges that were ultimately dropped.Vidaurre-Luis’s lawyers say that he and his wife left Peru in 2022 to seek asylum and have done what they were supposed to do. They said he received something in the mail accusing him of a crime he did not commit and ordering him to appear in court over charges that were later dropped.His lawyers did not specify what offense was involved.They also say that Vidaurre-Luis has been denied due process and has been in federal prison in Pennsylvania for five months when he should not be.Court records show that he has been seeking habeas corpus, a legal challenge to his detention while his case is considered in immigration court.His wife, Laura Ramirez, said the situation has been difficult for her and their 5-year-old son."My son cries every day for his dad to come home. My husband missed our 10th anniversary, my birthday, and Christmas and Easter with our family," she said.A spokesperson for the Department of Homeland Security said Vidaurre-Luis was in the country illegally."His criminal history includes a felony charge for attempting to evade arrest. Vidaurre-Luis illegally entered the country in 2022 and was released into the country by the Biden administration," the agency said. "He is in removal proceedings and will receive full due process."
