Immigration attorney Nikolas De Bremaeker confirmed Friday that Lesly Rodriguez Gutierrez, 28, and her children, ages 4 and 6, were deported to Colombia. Attorneys previously said the children were 5 and 7 years old. A 28-year-old Colombian asylum seeker, Gutierrez immigrated to the U.S. four years ago with her two children. She did not have a criminal record, De Bremaeker said. Read more: California Congress members demand answers on deportation of 6-year-old deaf child, family “This is a sudden change in ICE’s policy … pulling the rug from under immigrants who have been complying, doing everything possible to comply with orders,” De Bremaeker told reporters during a news conference about the Immigration and Customs Enforcement action. “It’s inhumane, it’s illegal, and it’s unconstitutional,” he added. Federal agents have arrested many undocumented immigrants who have reported for check-ins at the San Francisco and Stockton ICE offices since President Donald Trump took office. Gutierrez and her children were detained Tuesday while reporting to a routine check-in at the ICE office in the South of Market neighborhood, her attorney said. Her 6-year-old son is deaf and did not have his assistive equipment when they were detained, the attorney said. Attorneys and family members scrambled to find Gutierrez and her children after they were detained, but were given false and misleading information from ICE officials, De Bremaeker said. ICE spokespeople did not respond to Chronicle requests for more information about Gutierrez’s detainment. California State Superintendent of Public Instruction Tony Thurmond condemned the family’s deportation and called on the Trump administration to return the family to the U.S. “No child should be ripped from their home community and hidden in a detention center, especially not a Deaf child who is being deprived of the ability to communicate and understand what is happening to him,” Thurmond said in a statement.
