BOISE, Idaho — The Department of Homeland Security (DHS) and Idaho's governor on Tuesday weighed in on an FBI operation where hundreds of federal, state and local agents raided a horse racing facility in Canyon County on allegations of illegal gambling. Nearly 200 federal, state and local law enforcement officers descended on the facility Sunday to execute a search warrant at the La Catedral Horse Arena in Wilder. According to the FBI, four people were arrested on Sunday and a fifth on Monday evening in connection to the investigation. Dozens of others were detained Sunday by U.S. Immigration and Customs Enforcement (ICE), including spectators and children who were there to watch the races. Idaho Gov. Brad Little's office on Tuesday confirmed more than 400 people attended the event. KTVB was on the scene during Sunday's operation, and the community gathered outside demanding the release of the children in federal custody. A release from Little's office said, in part, "when serving a search warrant, it is common practice for law enforcement to detain others present while processing the scene to ensure the safety of both the civilians and officers present and to preserve evidence." Additionally, the DHS confirmed 105 undocumented immigrants in attendance at Sunday's event were taken into custody and said, in part, it was "dismantling criminal networks in the United States." None of those 105 people taken by federal agents were children, according to the governor's office. Sunday's FBI raid was conducted as part of what it described as "court-ordered activity" at the La Catedral Arena, as the owner of the property, Ivan Tellez, is facing one count of conducting an illegal gambling business under federal law, according to a criminal complaint filed Oct. 15 in U.S. District Court in Boise. The FBI stated in a news release four people were arrested and charged with federal complaints: Ivan Tellez, 37, of Wilder, Idaho; Samuel Bejarano, 37, of Nyssa, Oregon; Dayana Fajardo, 39, of Nyssa, Oregon and Alejandro Estrada, 56, of Buhl, Idaho. Tellez and Orozco are permanent residents of the United States. The three others arrested, Fajardo, Estrada, and Bejarano, are undocumented. Out of the 105 detained by federal agents, some have been released, while those who remain were taken to locations in Utah, Rigby, and Burley, according to an attorney with Ramirez-Smith Law. Attorney Nikki Ramirez-Smith said she is working with numerous detainees to secure them legal representation. On Wednesday, Senate Minority Leader Melissa Wintrow called the situation "appalling" and is standing with the families and children affected in the Wilder raid. "Let’s be clear: ICE presence in our communities does not promote safety — it fuels fear. The State of Idaho provided support in the service of a warrant issued by a federal judge in connection with the illegal activities taking place in Wilder," Gov. Little said. The Federal Bureau of Investigation led a monthslong investigation in coordination with the Treasure Valley Metro Violence Crime and Gang Task Force and served a warrant, issued by a federal judge, at the Canyon County facility.
