Federal judge says ICE made warrantless arrest in June arrest outside Baltimore schoolBALTIMORE —On Thursday, a federal court judge determined Immigration and Customs Enforcement officers conducted an invalid, warrantless arrest that violated Jesus Acevedo Sanchez's Fifth Amendment right to due process.His attorney, Rachel Savage, told WBAL-TV 11 News earlier this month that's what she planned to argue in court."It was a warrantless arrest and not based on any probable cause," Savage had previously told WBAL-TV 11 News Investigates.Savage told WBAL-TV 11 News Investigates that the family had left a Dunkin' Donuts when an unmarked car swerved in front of them, forcing Acevedo Sanchez to slam on his brakes. She says men jumped out dressed in black and pointed a gun at him. She said Acevedo Sanchez, fearing for his family's life, sped away seeking safety at the children's school. It was then, the attorney said, that the man noticed police lights and realized the armed individuals may have been federal agents. "They finished breaking the glass out of Jesus' window," the attorney said. "They used what they termed 'vehicle extraction techniques,' which basically means ripping him out of the car with the seat belt on." ICE arrested him for allegedly refusing lawful commands and violently resisting arrest. The federal agency said when he sped away, he dragged an ICE agent in the process.Acevedo Sanchez suffered injuries including bleeding from his leg and face. ICE then turned its attention to Gavilan Sanchez."They said cooperate with us because if you don't, we will do to you what we did to your husband or worse," Savage told WBAL-TV 11 News Investigates."ICE officials contend agents arrested the mother for assault after she allegedly punched agents.Earlier this month, a federal judge ordered her release. The couple is from Mexico and do not have legal immigration status in the United States, but their daughters are U.S. citizens. Since the arrest, the children have been staying with relatives.ICE has not responded to our request for comment.
